Govenor Holden's motion to dismiss says Kinder's petition is not representative of the Missouri legislature and lacks the legislature's approval.
Holden also claims courts should not become involved with political disputes, leaving them to the legislative and executive branches to decide.
Finally, Holden states that because collective bargaining was issued through an executive order and not legislation, it was within his power. Therefore, Kinder's claims are not legit.
Attorney General, Jay Nixon, summitted the motion to dismiss.
