Senator Peter Kinder is appealing a decision today/Thursday that upheld Attorney General Jay Nixon's right to use independent attorneys in last year's tobacco settlement.
Kinder says hiring the attorneys may cost up to 400-million dollars, which could come out of the state's settlement money.
Kinder accuses Nixon of having alterior motives.
A spokesman for Nixon says it was necessary to hire the attorneys to compete with the tobacco companies' powerful defense. He also says the the tobacco companies, not the state, will foot the bill.
